Nanny Contract template

A nanny contract sets out a nanny's schedule, pay, overtime, taxes, duties, time off, house rules, and termination terms, so the family and nanny agree on expectations from day one.

A nanny contract (or nanny agreement) is a written agreement between a family and a nanny that sets out the schedule, pay, overtime, duties, time off, house rules, and how either side can end the arrangement. You need one before the nanny's first day, because unspoken expectations on hours and duties are what end most nanny relationships.

Our take: Our take: families often forget that hiring a nanny usually makes them an employer. In the US, a nanny is generally a household employee, not a contractor; if you pay above the annual IRS threshold, you typically owe Social Security and Medicare taxes and must issue a W-2, and federal and state minimum wage and overtime rules apply to most nannies, including live-out nannies paid a weekly salary. States add rules of their own, and some have a domestic workers' bill of rights. Write down the guaranteed hours, the overtime rate, and what happens when you go on vacation. The contract protects the nanny as much as the family. For general employment terms, compare our employment contract; for a written offer before the contract, use an offer letter.

When should you use a nanny contract?

  • When hiring a full-time or part-time nanny, live-in or live-out
  • When sharing a nanny with another family (nanny share)
  • When changing hours, pay, or duties for an existing nanny
  • When a babysitter becomes a regular, scheduled caregiver

Frequently asked questions

Is a nanny an employee or an independent contractor?

In the US, a nanny who works in your home under your direction is almost always your household employee. That means employment taxes, a W-2, and minimum wage and overtime rules usually apply.

Do I have to pay my nanny overtime?

Generally yes, for hours over 40 in a workweek under federal law, and some states add daily overtime. Live-in nannies are exempt from federal overtime, but some states still require it.

What are guaranteed hours?

A promise to pay a set number of hours each week even if you don't need the nanny for all of them, for example when you leave early or travel. It is standard in professional nanny contracts.

Can we sign a nanny contract online?

Yes. A nanny contract is a private agreement that can generally be signed electronically, and eSignSimple gives both sides a signed PDF copy.
